today that Blue Rhino Global Sourcing, LLC has received a favorable ruling in
the International Trade Commission proceeding brought by American Biophysics
Corporation (ABC).
In the ruling dated Friday, September 10, 2004, Judge Sidney Harris of the
International Trade Commission concluded that the 2004 model of Blue Rhino's
SkeeterVac(R) mosquito trap does not infringe ABC's alleged patent rights.
American Biophysics had sought to prohibit Blue Rhino from importing and
selling its 2004 models of the SkeeterVac(R) mosquito trap because of alleged
patent concerns relating to ABC's Mosquito Magnet products. Blue Rhino has
maintained throughout these proceedings that its SkeeterVac(R) mosquito traps
do not infringe ABC's alleged patent rights and that the action brought by ABC
in the International Trade Commission was without merit.
